That is really the magical element behind the multi-billion dollar market that is the direct sales and network marketing industries. And a large part of those are MLM-fashioned businesses that offer primarily are styled as health and wellness supplements in the name of weight loss, cognitive enhancement, skin care, hair care, beauty, anti-aging, dieting and anything else nutritionally-related or health-focused. 

But the FTC’s newfound toughness may come to naught in the Trump era. There’s little hope, according to both critics and cheerleaders of the MLM industry, that the Trump administration will assume such a strict posture toward Herbalife’s peers. “The more likely scenario is that they just won’t bring a pyramid scheme case,” said Bonnie Patten, executive director of Truth in Advertising, a consumer advocacy group that helped the FTC in its prosecution of Vemma, a nutritional-product MLM that the FTC alleged was a pyramid scheme in August 2015. The case was settled in December on terms similar to the Herbalife one. (Neither Vemma nor Herbalife admitted guilt in their settlements.)

I was disappointed to see Plexus at #28 and I wasn’t impressed by what you had to say about them. Plexus is NOT a weight loss company. Their products promote a healthy gut and they are clinically proven to decrease inflammation and balance blood sugar. Weight loss is a natural side effect of body balance. The products work and there are a lot of people I know personally making good money with Plexus.

Because of its relational aspect, the products usually involved, and the gender of the consultants themselves, women are the predominant target for MLM strategies. During the Obama administration, the Federal Trade Commission made its biggest-ever effort to curb this industry when last summer it slapped nutritional supplement–seller Herbalife with a $200 million fine and, as part of a settlement with Herbalife, demanded it restructure its business so that it would “start operating legitimately,” as FTC Chairwoman Edith Ramirez put it. The FTC alleged Herbalife had engaged in “unfair and deceptive practices,” and put it under a federal monitor for seven years, demanding onerous changes to its compensation plan and requiring extensive documentation of customer sales. Ramirez then set down an ambitious posture for the FTC: In the future, she said at an MLM industry conference in October, these companies should adopt the new Herbalife rules when structuring their businesses, as the FTC would be watching. 

Looking compliant is easy. Building a CULTURE around compliance is hard. Building a culture requires doing more than paying lip service to compliance. It requires full buy-in at the corporate level to teach and enforce the important policies. You can achieve success in a network marketing venture if avoid common MLM mistakes, gain a solid understanding of the industry, choose a company carefully, find a quality sponsor, and commit time and effort to your business.

A good MLM will have more than a few products to sell. They will have more than market sector covered (not just nutritional supplements, water filters or essential oils). They will also have other major retailers that they market for. The money those major corporations spend on the annual marketing, will be paid out to the MLM and their distributors for their sales & marketing efforts and results. Carl Rehnborg is credited as having started the multi-level marketing industry back in the 1930s. After learning about the benefits of dietary supplements in China, Rehnborg came back to the United States and started a company called The California Vitamin Company, which was later rebranded to Nutrilite. Six years after that rebranding, Rehnborg reorganized the company’s structure and the way it sold products into what we know as MLM today.
“Fast forward 10 years or so from the home equity line of credit losing, after we had paid off our home mortgage, we were in the process selling our home and purchasing another home,” he wrote. “We had to close the unused line of credit. We had to get a satisfaction letter to move forward with the new home purchase. We were fortunate that we never had a need to tap into the line of credit for any purpose, including educating our children. While a home equity line of credit may be beneficial and perhaps needed by some we simply decided to live within budget and never had to use [it] for any purpose.”
I see Melaleuca on here. I see that as both good and bad. They are an awesome company with a great compensation plan. However, they are not an MLM. They are not even listed with the federal agency that oversees those companies. They are a Consumer Direct Marketing company. How does that differ? While I am required to purchase a certain amount each month, that’s all I need to purchase. It’s all products I use in my own home for myself. I don’t have a monthly quota to meet. I don’t have to buy product and sell it to people. The idea is that the product goes to the consumer only. In fact, it’s against company policy to buy product and sell it to others. The only comparison I see are the “levels” of customerS in my group. Can you shed any light on why you think they are an MLM? Thanks, so much!
The gist of the matter is that the courts have found that as long as an MLM can show that its primary purpose is to sell product (even to people within the MLM) and not recruitment of distributors, the company is considered a legitimate business and not a pyramid scheme. But this line is really fuzzy, and little to no effort is made by law enforcement agencies to make companies prove that they emphasize retail over recruitment.

The cons of mlm are that most people getting into mlm don’t understand mlm. They apply the incorrect philosophy and it becomes a recipe for disaster. I see dozens of people monthly that join a mlm, don’t work and don’t yield any results and as a result, leave with a bad taste. But with correct leadership that problem could be averted. That is precisely why I love my company. It has the best leadership (in my opinion) and they properly train their agents.
The reality is there’s nothing special about the stuff MLM companies sell. You can find whey protein and meal replacement shakes at your local CVS or online. You can buy essential oils at Whole Foods and Amazon. Your wife can buy quality make-up and skincare products at Ulta, Walgreens, or online. You can get pretty much anything an MLM sells and often for much cheaper, even when your MLM distributor discount is factored in (see the next section). There’s nothing significantly different about MLM products besides the marketing and branding.

Nutritional supplements are not classified as either “foods” or “drugs”. They’re not foods because you don’t eat them for sustenance (you eat them to “supplement” your existing diet). Many self-proclaimed entrepreneurs send me invitations and accolades to join their favorite Multi-Level Marketing (MLM) or Network Marketing company, but these all sound like "get rich quick" schemes to me. For me, the essence of an entrepreneur is creating something new and innovative, whereas an MLM is a traditional formula on an existing product with a high premium on pyramiding.

Good companies find ways to intelligently leverage technology. Thanks to Amazon and Wal-Mart, we’re all spoiled. We want what we want, we want it NOW and we want it delivered for free. Smart network marketing companies are eliminating as many barriers as possible to make it easier for consumers to place and receive orders. They’re finding ways to make it easier for consumers to connect via mobile apps, tell stories via social media tools, provide best-in-class web experiences and leverage as much data as possible to stay ahead of consumer demand. The corporate team also needs to leverage technology to enhance workflows.

They have the stay-at-home-mother meets women entrepreneur mixture working for them. What does that even mean? You may remember Rodan + Fields in their former iteration when they sold acne medicine via infomercial. Or when Estee Lauder bought the brand and sold the products in stores. Now they tempt stay-at-home moms with promises of lucrative, flexible careers, free vacations, and six-figure incomes. All they need to do is sell some upscale skin care products via direct sales.

Jim’s friend who recruited him into the company starts telling Jim that the way you really start making money with Company A is recruiting other people beneath you to sell shakes. “When you sign someone up,” explains Jim’s friend, “you will start getting a 10% commission on the product your recruit is required to buy from Company A in order to qualify as a distributor.
