With her departure on Feb. 10, there are only two commissioners remaining on the FTC and the acting chairwoman, Republican Maureen Ohlhausen, is a staunch supporter of self-regulation by MLMs. Trump will appoint three new FTC commissioners, including the chairperson. Whether it’s Ohlhausen or someone else, the next chairperson is also likely to be sympathetic to the MLM cause. The only name floated for the spot so far has been Republican Utah Attorney General Sean Reyes, who was also greeted with glee by MLM shareholders when his consideration was reported by Politico on Jan. 17.

The way pyramid schemes are structured requires them to constantly recruit new people into the scheme. But this is unsustainable because at a certain point you run out of new recruits either because 1) you can no longer find anyone interested in joining, or 2) everyone on earth has become a member of the pyramid scheme. When you run out of new recruits, the pyramid collapses, leaving those at the bottom with a loss.
If the company is solvent, meaning it has the capital required to grow, maintain a solid infrastructure, attract talented management, keep pace with technology, and pay your commissions, then you may proceed. Publicly traded companies are required to disclose their financial condition in great detail every 90 days to the U.S. Securities and Exchange Commission (SEC) and other governmental agencies. Unfortunately, private company financials are not available to the public, so you may have to take a risk in working for one.

MLM salespeople are, therefore, expected to sell products directly to end-user retail consumers by means of relationship referrals and word of mouth marketing, but most importantly they are incentivized to recruit others to join the company as fellow salespeople so that these can become their down line distributors.[3][6][7] According to a report that studied the business models of 350 MLMs, published on the Federal Trade Commission’s website, at least 99% of people who join MLM companies lose money.[8][9] Nonetheless, MLMs function because downline participants are encouraged to hold onto the belief that they can achieve large returns, while the statistical improbability of this is de-emphasised. MLMs have been made illegal in some jurisdictions as a mere variation of the traditional pyramid scheme, including in mainland China.[10][11]


In April 2006, the FTC proposed a Business Opportunity Rule intended to require all sellers of business opportunities—including MLMs—to provide enough information to enable prospective buyers/participants to make an informed decision about acquiring/joining a business venture with information disclosed about the average likelihood of monetary profitability (and the extent of monetary profitability, if any) of acquiring/joining the business venture. In March 2008, however, the FTC removed "Network Marketing" (i.e. MLM) companies from the proposed Business Opportunity Rule, thus leaving MLM participants without the ability to make an informed choice of entering or not entering MLMs based on the disclosed likelihood of success and profitability:

The Internet has made it so easy now. In the old days you had to actually visit people, or at least call them, to pitch your fabulous new opportunity. Face-to-face marketing is still practiced, but it is not so common these days. Besides, no one really loves the idea of having someone over, so they go online where everyone can be as safe as they want. They create sites with videos, testimonials, and pictures.
In March I joined an MLM company and I’m lost… my first reaction to network marketing was I’m not a sales person, to which I was told it’s not about sales but about building relationships. The other thing that makes me crazy is I see a lot of folks who appear so fake with their bubbly “everything is coming up roses and bubble gum” that I cringe. I’m honest to a fault and happy but not giddy. Almost every pension plan is underfunded around the world. Record low interest rates haven’t helped. The hard facts of the times we live in today are that you CANNOT rely on any other organization or government to take care of you in retirement. You will be expected to work longer and delay taking benefits as pension fund managers make desperate attempts to stretch fund assets as far as they can go for as long as they can before finally calling in the administrators when they cannot hide from their insolvent situation any longer. The same for government pension and welfare programs - the sheer number of pensionable age people in the population will be simply too costly to support as they outnumber those working and paying taxes.

I found your article interesting. My wife and I have been involved with AdvoCare since November 2011. Even if I never make another dime in AdvoCare, I will continue to use the products because they have worked and continue to work for us. What I find interesting is the statistic that the majority – 99.7% in MLM actually “lose” money. What is the context of that statistic? That would mean A: the majority of MLM companies don’t have a buyback or return policy B: people that get started with MLM’s have to take on much more inventory that they are able to sell or C: this statistic is not accurate. I believe that C is the right answer. I do agree there are flaws in the MLM industry just as there are flaws in every industry. However, I believe that the MLM industry has made huge improvements in recent years and we do have a better way. People are the variable. When you have a great product, a passion and purpose that drives you everyday, are teachable and coachable, and love others as much as you love yourself, you can be successful in this business. Through the process of investing in your own personal development and learning to serve others, you are able to lead others to do the same. Thanks again. Nutritional supplements are not classified as either “foods” or “drugs”. They’re not foods because you don’t eat them for sustenance (you eat them to “supplement” your existing diet). And they’re not drugs because they’re not intended to treat any condition. The FDA largely ignores the industry, which means MLMs don’t face the same harsh regulations as food or drug providers in other industries.
Jim’s friend who recruited him into the company starts telling Jim that the way you really start making money with Company A is recruiting other people beneath you to sell shakes. “When you sign someone up,” explains Jim’s friend, “you will start getting a 10% commission on the product your recruit is required to buy from Company A in order to qualify as a distributor. If you can get 3 people to sign up, it means you would be earning 10% commission on all the product those 3 recruits are required to buy, plus whatever they purchase beyond that minimum.”

Why everyone goes with different companies i don’t get it, check it out compare to mary kay. Here’s the thing though, I contract with amway, but my organization is worldwide. Mentorship organization. I feel which ever MLM business you choose, join a mentorship organization that is in that business. The reason why amway is number one is because of worldwide. it’s only 10% of everyone that is in amway, yet 90% of the 6 and 7 figure earners are part of worldwide…why? because they broken down the company and know exactly how to succeed and retire quicker than someone who tries amway on their own or joins another mentorship company. what’s the success rate? to those who do what others have done 100%. So at the end of the day, consider all of this. With amway and worldwide, it doesn’t matter how old you are, where you come from, ANYONE can do it. Mary Kay is a female company, good luck getting a bunch of single dudes to make it with that.
When you join an MLM, you’ll be pressured to utilize your social network by pitching the product to friends and family, and encouraging them to become distributors themselves. First, your MLM recruiter will tell you to hit up your “warm leads” — your family members and close friends. After you’ve tapped that out, they’ll tell you to reach out to co-workers and even old high school pals. When you’ve drained that vein, they tell you to start pitching to random strangers in public or on the internet. That’s why it’s called network marketing.
The U.S. Federal Trade Commission (FTC) states: "Steer clear of multilevel marketing plans that pay commissions for recruiting new distributors. They're actually illegal pyramid schemes. Why is pyramiding dangerous? Because plans that pay commissions for recruiting new distributors inevitably collapse when no new distributors can be recruited. And when a plan collapses, most people—except perhaps those at the very top of the pyramid—end up empty-handed."[45]
(Update: In April of 2017 there was an article posted about this company, so as of May 2017 it is unsure if this company has gone under.)  First off, to sign up and become an affiliate of the company you might do a double or triple or quadruple take at the startup cost (which is almost 4 figures).  However, you do get to truly set up your own business, because you can set the price on all the products you sell.  If you have that business talent to make consumers buy the products (which are legit btw) you can certainly make that start-up cost back in no time.  This company has also been achieving some high praise by being the recipient of many awards (including a growth award from the Direct Selling Association).

They’re pretty future-facing in general, having implemented an innovative social marketing strategy amongst their reps. No one likes to be harassed on Facebook, but Modere’s social media plan is still 10 times more effective than holding home parties (kill me).

Almost any product or service could be sold through multilevel marketing, including health, beauty, and fitness products that aren't available on store shelves. Apply a healthy dose of skepticism before buying or selling products advertised as having "miracle" ingredients or guaranteed results. Many of these "quick cures" are unproven, fraudulently marketed, and useless. In fact, they could be dangerous. You may want to check with a health professional before using them — or selling them.

We do $1B/year in sales and are breaking records every day with an annual growth rate of 30%+ annually. Some of the “top 10” are nowhere near these stats.
